Obtaining a patent is a crucial step to safeguard the intellectual property of a novel biomedical invention and to raise funding for its development. In this five-week learning-by-doing course you will learn the pros and cons of patent protection and how to protect your biomedical invention in a timely and optimally manner. In addition, you will learn the interplay between patent law and market exclusivity for medicinal products granted by regulatory agencies such as the FDA and EMA.

Scholarships

Biomedical professionals who are currently working at a university, university medical center, or research institute in the Netherlands and have not previously taken a course at Paul Janssen Futurelab can apply to receive a scholarship covering 50% of the course fee. One scholarship will be awarded to each organization a first-come, first-served basis. What makes this course special?

This course does not deal with intellectual property rights such as trademarks, copyrights or  design rights but we focus here on patent rights. Other IP rights can be useful to protect a biomedical invention, for example, obtaining design rights as part of the design of a medical device. However, patents are the most common and generally offers the most extensive protection for a biomedical invention. To practice the principles, several case studies that are based on real-world biomedical inventions are included. These cases range from simplistic to extensive to illustrate the complexity and the dynamics involved in patents in this field.

What will you learn?

In 5 weeks, you are introduced to the world of IP for new medical inventions. You will learn the value of a

patent (and its limitations) for biomedical research and how to take these into account for a worldwide patent strategy. A worldwide strategy includes obtaining multiple patents and creating a patent portfolio for your invention. It is essential to properly maintain a patent portfolio and to design a strategy well before obtaining your patent. Our experts share with you some tricks of the trade at different stages in the lifetime of your patent. Finally, you will also learn about the interplay between patent law and the granting of market exclusivity for medicinal products by regulatory authorities such as the FDA and the EMA. Upon completion of this online course, you will have a clear understanding of the basic principles and the do’s and don’ts to protect your biomedical invention in a timely manner.
